On or about February 4, 2016, we sent out a notice concerning the appointment of GALs in the Fifth Judicial Circuit (see below; old order removed). We recently received another email from Judge Farmer advising that the Order that was provided with the original email has been revised. Following is a memo that the NNBA received from the Judges of the Fifth Circuit:
an effort to standardize practices in the Fifth Judicial Circuit regarding the
appointment and payment of guardians ad
litem in custody and visitation matters, the Court has developed the
following standard practices:
1. On all appeals, the guardian ad litem appointed in the Juvenile and Domestic Relations District Court
remains the guardian ad litem in
Circuit Court. There is no need for the
entry of a new order appointing the guardian ad litem. The guardian ad litem will be paid at the same rate
as in Juvenile and Domestic Relations District Court ($75.00/hour in court and
$55.00/hour out of court) and will submit a form DC-40 requesting payment.
2. In all cases involving custody and visitation originating
in Circuit Court, the Court will appoint a guardian ad litem upon a written motion filed by either or both
parties. Please review the order carefully
and note the specific parameters regarding the payment of guardian ad litem fees.
It is the intent of the Court to begin enforcing standard
practices on May 1, 2016. We are
providing a 30-day comment period to allow attorneys an opportunity to provide
feedback regarding any concerns they may have with the proposed standard
